Plaintiffs from around the country are retaining lawyers and heading to the courts for justice. In a series of recent court filings, plaintiffs have filed lawsuits against the manufacturers of Paraquat (Gramoxone) alleging that exposure to the herbicide caused the development of serious health conditions and the manufacturer Syngenta failed to warn of the health risks.
These complaints are being filed by growers, farmers and agricultural workers who had several interactions with Paraquat that include:
Our Paraquat lawsuit helpline has also fielded calls from concerned individuals who live in close proximity to crops where the dangerous chemical herbicide was sprayed.
Our experienced attorneys will be writing summaries of the various lawsuits as they are filed on our blog.
A paraquat lawsuit was filed in October 2017 by farmers, growers and agricultural workers who were exposed to herbicides containing paraquat - and who allegedly developed Parkinson’s Disease as a result. Claimants say they were unaware of the life-threatening health risks associated with spraying, loading, or handling the herbicide manufactured by Syngenta and Growmark.
No. Our attorneys do not intend to file a Paraquat class action. We feel that class actions are more appropriate when the damage to all consumers or members of the class is the same. In this instance, the severity and extent of injuries vary greatly from person to person. From that perspective we intend to file each case as its own lawsuit.
In some litigations where there is a common defendant, and where a federal judge or state court judge determines it appropriate, the cases are consolidated for litigation purposes so that all discovery can be shared across the various cases to save on resources for both the court and all parties involved. This is called a Multi District Litigation in federal court, and various states have their own versions of it in state court. A Paraquat MDL has not yet been established in federal court. If there are a large volume of plaintiffs who come forward alleging that Syngenta's herbicide (the Swiss manufacturer) caused their Parkinson's disease (a neurodegenerative disorder) or end-stage renal failure, then their could be an MDL.
We understand what you are going through. You are likely very angry right now to learn that the injuries and pain your body has had to endure could have been avoided. Your medical bills are mounting. You want justice.
Our lawyers are fielding a large number of calls from individuals who allege that herbicide Syngenta caused their Parkinson's Disease, renal failure, and other health problems.
We know you work hard for a living. We will stand with your in your fight to get justice against the manufacturers of chemicals that some consider a poison or toxic chemical.
All studies are cited below with information about the releasing body.
In February 2011, the National Institute of Environmental Health Sciences, in conjunction with the journal Environmental Health Perspectives, conducted a study that concluded with the suggestion that exposure to Paraquat and similar herbicides had a link to Parkinson's disease. The study, which was part of a larger Agricultural Health Study, concluded that individuals exposed to the herbicide were 2.5 times or 250% more likely to contract Parkinson's disease compared to the control group who were not exposed to Parkinson's disease. The study was considered statistically significant with 80,000 farmers, sprayers, mixers, applicators, supervisors, helpers, and their spouses being tracked. Syngenta, the Swiss herbicide manufacturer of Paraquat disagrees with the outcome of the study stating that since only one hundred and fifteen study participants developed Parkinson's disease, a causal link cannot be made.
In October 2012 a study was conducted on individuals who used Paraquat. The study followed participants to measure how many were subsequently diagnosed with Parkinson's disease. The study concluded that farmers who used Paraquat, and who also had a specific genetic variation, had an increased risk to developing the condition. The value increase was eleven fold. The study determined that those exposed to Paraquat were at a much greater risk for developing Parkinson's disease.
This study broke in December of 2016 where the outcome suggested that those exposed to Paraquat developed genes that could possibly result in developing Parkinson's disease. CRISPR is an advanced gene technology which can edit genes and is hailed as the future of medicine by many. This study backs the findings by FAME referenced above and also found that Paraquat caused oxidative stress on brain cells.
At this stage in the litigation, it is far too early to tell. A lot of discovery needs to play out before we really understand the just compensation deserved to each and every plaintiff. Each case will also be different. The injuries and severity of injury of one plaintiff can and will vary from person to person. These types of cases can take a long time to resolve. We are talking potentially several years here. Our personal injury attorneys will need to prove a link between Paraquat and the medical conditions we allege in our lawsuits. We will need to provide and collect all medical expenses related to the conditions for every plaintiff. A lot of work has to happen to move this case along. We promise to be transparent with all of our clients. All our clients will receive regular litigation updates and when the time comes to value your claim, we will have that discussion with you.
Unfortunately many suicide attempts are made with this weed killer. If taken at a specific dosage, the chemical can cause heart failure, slow movement, liver failure and severe human health issues and complications that can lead to long term disability or death.
Our attorneys have been asked if having tremors will qualify one for a claim. Tremors may mean there is an undiagnosed Parkinson's condition. Our law firm will work with you to ensure you get fully evaluated for this condition. Tremors can be fast twitching or a slowness of movement of your extremities.
It costs you nothing to find out if you qualify. The consultation is 100% free.
Our law firm will also front all litigation expenses.
If we fail to recover compensation, you owe us NOTHING. Zero dollars. $0.
You will only pay us for our legal services if we succeed in recovering compensation for you.
Call us today for a free consultation. We look forward to fighting in your corner.
